With the following bills scheduled for hearings in coming weeks, the California Apartment Association’s staff is analyzing their potential impacts on rental housing — and CAA subcommittee members are preparing appropriate positions on the legislation:
AB 1513 (D-Fox, Palmdale) – Residential Property Trespass: This bill would provide that a person who knowingly holds and occupies any residential property, owned or managed by another, by force or threats of violence, or knowingly enters residential property without the property owner’s express written permission and refuses or fails to leave the property after being requested to leave by the owner or agent of the owner is guilty of a felony.
AB 2181 (D-Bloom, Santa Monica) – Seismic Safety: This bill would require upgrades to seismic concrete residential building identified as potentially hazardous.
AB 2256 (D-Garcia, Bell Gardens) – Service by Mail: Among other things, this bill authorizes a sheriff or marshal to serve a summons and complaint by mail, and would allow the person or business organization to accept service by mail by executing a written acknowledgment of receipt of summons, upon which date service would be deemed complete.
AB 2310 (D-Ridley-Thomas, Los Angeles) – Unlawful Detainer – Weapons & Ammunitions: This bill would reenact provisions authorizing a city prosecutor or city attorney in specified counties to file an action for unlawful detainer to abate a nuisance caused by illegal conduct involving an unlawful weapons or ammunition. The bill would allow the action to be based on an arrest report or other report. The bill would require, prior to filing an action specified notice be provided to the owner of the property, requiring the owner to evict the person who is violating the law.
