AB 3088 – The COVID-19 Tenant Relief Act of 2020

The COVID-19 Tenant Relief Act of 2020 (“CTRA”), commonly known as AB 3088, was passed by the California Legislature on August 31, 2020 and was signed by Governor Gavin Newsom. An urgency measure, AB 3088 took effect immediately. CTRA provides sweeping new protections from eviction for residents unable to pay rent and other charges due between March 1, 2020 and January 31, 2021 due to circumstances directly related to the COVID-19 pandemic. It also extends the “just cause” protections of the Tenant Protection Act of 2019, commonly known as AB 1482, to all properties through January 31, 2021. This Industry Insight provides an overview of the new law.
