This form contains the essential legal terminology for landlords who wish to alter the rent for a month-to-month tenancy for a rental unit that is subject to the San Jose rent freeze ordinance adopted on February 2, 2021.
A resident who has experienced COVID-19-Related Financial Distress can prevent a rent increase from taking effect by signing and returning a Declaration of COVID-19-Related Financial Distress to the landlord before the effective date of the rent increase. The landlord is required to provide a blank Declaration of COVID-19-Related Financial Distress to the tenant together with any rent increase served while the rent freeze ordinance is in effect.
For more information about the rent freeze ordinance, see CAA’s Industry Insight – San Jose Eviction Moratorium & Rent Freeze.
