The Santa Rosa City Council next week will consider adopting an “urgency” just-cause-for-eviction ordinance, which would require rental property owners to prove “cause” in court or before a political body every time they need to remove a problem resident.
An “urgency” ordinance, on the Tuesday, July 19 agenda, would require a five-vote majority for passage and would take effect immediately. If the urgency ordinance fails to garner the necessary five votes, a “non-urgency” just-cause-eviction ordinance will be introduced and would only require four votes, and if passed at a second reading, would take effect 30 days later.

A special Santa Rosa City Council meeting was held on July 7 to consider an extension of the current rent moratorium ordinance, which went into effect on June 23. (Please note: The moratorium was scheduled to go into effect June 16, but was pushed back due to a delay in publication by the city). The moratorium was set to expire Aug. 6 unless extended.

A voter petition to repeal Burlingame’s longstanding law against rent control fails to meet requirements under California’s election code and cannot legally appear on the November ballot.
The full text of Measure T — which the initiative seeks to overturn — is missing from the petition, which CAA’s lawyers argue invalidates the ballot measure under state law.

Tenant advocates have now filed petitions in four Bay Area cities to qualify a rent control measure for the November ballot.
The latest filing came Monday, June 27, as tenant advocates turned in more than 11,000 signatures to the San Mateo city clerk.
Tenant groups are trying to qualify the San Mateo Community Preservation and Fair Rent Charter Amendment for the November ballot. The measure would limit annual rent increases to 4 percent and implement just-cause eviction policies.

It’s now up to election officials to determine whether a rent control initiative has qualified for the November ballot in Mountain View.
On Tuesday, June 14, the Mountain View Tenants Coalition submitted more than 7,100 signatures to the city clerk.
The Santa Clara County Registrar of Voters will now count and check the validity of the signatures. The coalition needed 4,671 registered voters to sign their petition to qualify the initiative for the ballot.
The California Apartment Association is closely monitoring this process to ensure it follows procedures outlined in the California Election Code.

Starting June 16, many owners of multifamily housing in Santa Rosa will face a 3 percent cap on rent increases.
The council preliminarily approved the 45-day measure May 10 and ratified it May 17, despite fierce opposition from the California Apartment Association North Coast.
Hundreds of rental owners opposed the measure through letters, emails and phone calls. Members and staff testified against the moratorium at council meetings, saying it would hurt small businesses and drive a wedge between property owners and the city. In mid-June, the city of Santa Rosa is expected to impose a moratorium on rent increases of more than 3 percent on the city’s older multifamily housing.
The measure, which won preliminary approval from the council Tuesday, May 10, is intended to limit rent increases while city staff drafts a permanent rent control and just-cause eviction ordinance, a process that could take several months.

Despite over six hours of public comment from stakeholders and strong opposition from local rental owners, the Santa Rosa City Council on May 3 voted 4-3 to direct city staff to draft a rent control and just-cause eviction ordinance.

The discussion, scheduled for Tuesday, May 3, at City Hall, comes one month after the Santa Rosa Rent Stabilization Subcommittee voted 2-1 to recommend the measures.
Owners and managers of rental units in Santa Rosa are urged to attend Tuesday’s meeting, which is scheduled for 5:30 p.m. at City Hall.

Once again, the San Mateo City Council has rejected a rent control proposal — this time in the form of an onerous relocation-assistance program.
The City Council’s decision Monday came after three hours of public testimony from local property owners, managers and real estate professionals about the dangers of the proposal.
The relocation-assistance ordinance would have forced rental housing providers to keep rent increases below 10 percent or face paying up to $21,500 for residents to vacate the unit – even after the end of a lease term.
