The California Apartment Association’s legal challenge to Mountain View’s rent control law is about to get its first court hearing. At 9 a.m. Tuesday, legal counsel for CAA will appear in Santa Clara County Superior Court to request a preliminary injunction against Measure V, the rent control initiative approved by Mountain View voters last November.

The Santa Barbara City Council on Tuesday decided against pursuing a rent control policy, opting instead to examine alternative approaches to the city’s housing shortage. Santa Barbara will now take a closer look at policies including enhanced mediation and rental inspections. The council also wants a task force to study a potential just-cause eviction ordinance, however, council members expressed reservations about the policy.

Lawmakers have introduced a bill to repeal the Costa-Hawkins Rental Housing Act, landmark legislation that exempts new construction and single-family homes from local rent control laws. AB 1506 was introduced Friday, Feb. 17, the last day to propose bills in the California Legislature for 2017. Assemblymen Richard Bloom, D-Santa Monica; Rob Bonta, D-Oakland; and David Chiu, D-San Francisco, authored the proposal with Sen. Ben Allen, D-Santa Monica, as a co-author.

CAA remains committed to overturning Measure L The California Apartment Association remains undeterred this week after a Contra Costa County Superior Court judge denied its motion for a preliminary injunction to halt enforcement of rent control in Richmond. Richmond’s rent control law appeared on the November ballot as Measure L and won approval despite a strong opposition campaign spearheaded by CAA.

The city of San Jose has adopted a use-it-or-lose it approach to rent increases. On Tuesday, the City Council voted to eliminate the banking provision from its rent control ordinance. Under banking, owners of rent controlled properties can decide to forgo allowable rent increases one year, knowing that they can apply the unused increase sometime in the future.
