In response to a CAA-led referendum, the El Cerrito City Council on Wednesday night repealed its “just cause” for eviction ordinance, a move that will prevent a costly election and keep a destructive housing policy off the books.
The decision came on a 4-1 vote, with Mayor
Rochelle Pardue-Okimoto dissenting.
The council initially passed the just cause
eviction law in May on a 3-2 vote. CAA immediately sponsored a referendum to
overturn the decision and collected nearly 2,000 signatures from El Cerrito registered

A coalition led by CAA — including
local businesses, the real estate sector, homeowners and other community
members – has qualified a referendum on El Cerrito’s “just cause” for eviction
ordinance.
To qualify the referendum, petitioners needed to submit 1,631 valid voter signatures to El Cerrito’s city clerk. On Thursday, the Contra County registrar of voters confirmed the success of that effort, counting 1,993 valid signatures.
A referendum filed with the support of the California Apartment Association, Contra Costa, will prevent El Cerrito’s “just cause” for eviction ordinance from taking effect next week.
Working with hundreds of local property owners, the business community, real estate leaders and concerned citizens, CAA submitted a petition on behalf of local residents with at least 2,159 signatures to El Cerrito’s city clerk, considerably more than the 1,631 valid voter signatures needed to qualify the referendum.

The
California Apartment Association is exploring its options after the El Cerrito
City Council on Tuesday granted preliminary approval to a “just cause” for
eviction ordinance on a 3-2 vote.
Council
members Janet Abelson and Gabe Quinto voted against the ordinance. A proposal
to create a rent registry also won approval on a 4-1 vote, with Quinto
dissenting.
The council must
formalize approval of the measures with a second vote, expected on May 21. In
the meantime, CAA is evaluating all avenues for a reconsideration.

More than 100 rental housing providers crowded El Cerrito’s City Council chambers this week to oppose a trio of policy proposals that threaten their investments.
The California Apartment Association mobilized rental housing owners and operators to attend the Feb. 19 study session, which explored proposed policies including “just cause” eviction restrictions, a rent-triggered tenant relocation fee, and a rent registry.
After hearing more than 3 1/2 hours of public comment — most of it coming from concerned rental housing providers — the council postponed further discussion and any action on the proposals to its March 5 meeting.
