An urgency ordinance preventing termination of tenancies without cause in Sacramento County failed to muster enough votes to pass. The ordinance was intended to stop rental owners from ending tenancies in order to avoid rolling back rents or being stuck with below market rents once a new state law, Assembly Bill 1482, takes effect on Jan. 1, 2020. Similar ordinances were recently passed in several jurisdictions throughout California, including Los Angeles and Milpitas. The Sacramento County Board of Supervisors will consider an emergency “just cause” ordinance Tuesday, Nov. 5.   To pass, an urgency ordinance requires approval from four of the five board members. The ordinance would immediately impose just-cause restrictions similar to those in AB 1482, the statewide rent control and just-cause eviction law taking effect Jan. 1.

Landlords with properties subject to Sacramento’s new rent control law will help fund the program through a $20-per-unit annual fee. The fee won approval Tuesday as the City Council ratified the budget for its new rent control and “just cause” eviction ordinance. More than 42,000 rental units are subject to the ordinance and the annual fee. The city will begin collecting it in spring 2020.

The Vallejo City Council passed an urgency ordinance on July 16 making it unlawful to increase rent for an existing or prospective tenant by more than 10% during a declared emergency. The rent cap already was in place following a proclamation of emergency declared by the city manager on June 27 and later ratified by the City Council on July 3. The new ordinance simply places the rent cap into the municipal codes so that it automatically becomes effective during any proclaimed emergency.

Election officials will determine by mid-October whether tenant activists collected enough valid voter signatures to place a rent control initiative before Sacramento city voters in 2020. Beginning in March, the Alliance of Californians for Community Empowerment and the Service Employees International Union used paid signature gatherers, volunteers, and their own staff to circulate a petition to place rent control before city voters. Although they missed the deadline to place the initiative on this November’s ballot, they kept collecting signatures in hopes of qualifying their measure for the next general election, now a year and a half away.

The California Apartment Association spent many years developing a good working relationship with the Sacramento County code enforcement staff. The effort continues to pay off for the industry. One example is the recent agreement between CAA and county staff to limit an increase of the annual Rental Housing Code Compliance Fee to only 50 cents. If approved by the Sacramento County Board of Supervisors, the fee will increase by 3.2 percent, from $15.50 per unit to $16 per unit, effective January 2019. The Rental Housing Association of Sacramento Valley, a regional organization serving single-family and multi-family rental owners and managers, has announced its merger with the statewide California Apartment Association. Following the merger, RHA was renamed CAA Sacramento Valley, becoming one of several local divisions operating throughout the state. RHA had been affiliated with CAA as an independent chapter since 1951. CAA is the nation’s largest statewide association serving the rental housing industry. Its membership includes over 13,000 single-family and multi-family property owners and managers, as well as businesses providing products and services for the industry.
