Although Santa Cruz voters rejected a rent control initiative by a wide margin this past fall, the city’s newly elected council has chosen to pass components of the measure anyway. In the Nov. 6 election, CAA helped secure the resounding defeat of Measure M, an initiative that would have brought both rent control and “just cause” eviction policies to the city of Santa Cruz.

Despite opposition from the California Apartment Association, the Marin County Board of Supervisors on Tuesday formally approved a “just cause” for eviction pilot program. The eviction controls are set to take effect Jan. 17, 2019, and will remain in place for up to two years. At that point, the pilot program will be reviewed for possible extension.

In a victory for the California Apartment Association, the San Jose City Council on Tuesday rejected a proposal to expand the city’s “just cause” eviction policies to include duplexes. Another decision by the council, however, is cause for concern. The council Tuesday also directed staff to draft a “source of income discrimination” policy for rental payments. Such an ordinance could ultimately force landlords to consider renting to Section 8 voucher holders, a decision the association believes should be left to property owners.

The Fremont City Council on Tuesday will hear a consultant’s report and staff recommendations on rent control and other policy options for addressing rising rents in the city. The Rental Housing Association of Southern Alameda County, a chapter of CAA, is urging its members to attend the meeting and speak out against the draconian, unnecessary policies being considered. The California Apartment Association is mobilizing its members to fight yet another push for stricter rent control in San Jose. A year after the city lowered its annual cap on rent increases from 8 percent to 5 percent, staff has recommended scrapping the percentage-based cap for a formula based on the rate of inflation. This is the type of formula used in San Francisco. A proposal to apply “just cause” eviction policies to non-rent-controlled housing in Los Angeles got a boost this week from the City Council. At present, just-cause eviction requirements apply only to the city’s rent-controlled housing. But under a proposal gaining traction in L.A., just-cause would apply to the city’s entire housing stock, regardless of whether rents are regulated.

Despite objections from the California Apartment Association, Los Angeles moved closer Wednesday to expanding its eviction controls to the city’s entire housing stock. At present, Los Angeles’ just-cause eviction policies apply only to rental units that fall under the city’s rent control ordinance. On Wednesday, however, the council’s Housing Committee directed city staff to examine expanding just-cause eviction policies to all rental housing in the city, regardless of size, type or year built. Staff has 60 days to return with a report on a possible ordinance.
