Pacifica last week passed an ordinance that bans smoking in multifamily
housing.

Carlos City Council is adopting a ban on smoking in multifamily housing that
includes a 14-month phase-in period secured by CAA.
The California Apartment Association worked with the city to craft an ordinance that protects renters against the harmful effects of second-hand smoke while giving tenants who smoke time to adjust their habits.
“You are trying to change their behavior, you’re not trying to evict the residents,” said Rhovy Lyn Antonio, CAA’s vice president of public affairs, as reported by the San Mateo Daily Journal.

Multifamily properties in unincorporated areas of Contra Costa County are smoke-free as of Sunday, July 1.
In March, the county Board of Supervisors unanimously adopted the Contra Costa County Secondhand Smoke Ordinance, which prohibits smoking inside multifamily properties with two or more units. Although the ordinance takes effect July 1, property owners and operators have until July 1, 2019, to amend house rules and make the necessary transition to smoke-free housing before fines can be imposed.
CAA Contra Costa does not oppose the efforts of local jurisdictions to promote smoke-free housing and protect residents from secondhand smoke.

The Redwood City City Council on Monday unanimously approved an ordinance prohibiting smoking in multifamily communities.
The ordinance applies to properties with more than two units and includes a ban on smoking inside units and all common areas. The smoking ordinance will officially take effect Jan. 1, 2019, for existing units and Jan. 1, 2018, for newly constructed units with a certificate of occupancy after Jan. 1, 2018.
CAA Tri-County does not oppose the efforts to promote smoke-free housing and protect residents from secondhand smoke.

The San Mateo City Council on Monday preliminarily approved a ban on smoking medical marijuana in multifamily communities.
The city already banned smoking in apartments but until now made an exception for medical marijuana.

After addressing CAA’s concerns, the cities of San Bruno and South San Francisco have approved ordinances prohibiting smoking inside multifamily units and common areas.
On Nov. 9, the South San Francisco City Council approved the second reading of its ordinance after adopting clarifications and other requests from the California Apartment Association, Tri-County Division. Those revisions include the following, which provide clarity and minimize impacts to property owners and operators:
Phase-in period of up to 12 months
Ability for owners to create designated smoking areas
No requirements of installing customized signage inside apartment units

After working with the apartment industry, the Burlingame City Council on Tuesday, July 7, voted to prohibit smoking inside multifamily units.
The 4-1 vote came after four months of discussions between the California Apartment Association’s Tri-County Division and the city.
CAA Tri-County’s objective centered on drafting an ordinance that would achieve Burlingame’s goal of protecting multifamily residents from second-hand smoke while also offering the clarity needed to minimize impacts on rental property owners and managers.

The Santa Rosa City Council on Tuesday postponed its vote to ban smoking in multifamily residences, opting instead to rework parts of the proposal so that it’s more amenable to the apartment industry.
The council had received numerous letters from local property owners, and a few voiced their concerns at Tuesday’s meeting.

Proposal needs clarity, consistency before adoption
A proposed ban on smoking in Santa Rosa apartment communities contains an unreasonably aggressive timeline and fails to offer landlords clear direction regarding their responsibilities.
The California Apartment Association is calling on the Santa Rosa City Council to revise the draft ordinance, which it will consider at its meeting next week.
