It’s only natural for the people of Fresno to experience outrage over the conditions at Summerset Village apartments.
More than a thousand residents went for weeks without heat and hot water. A number of code violations exist, and apartment residents should never have to withstand Third World living conditions –especially in the largest city in California’s Central Valley.
The residents at Summerset Village endured hardships at no fault of their own, and the Fresno community, including responsible rental housing owners and managers, are embarrassed about the substandard conditions.
As our community examines what went wrong, let us… Read More

Question: One of our tenants is moving out, but the roommate wants to stay and invite a friend of hers to take the outgoing tenants’ place. How do we indicate this on the lease?
Answer: One way is to draw up a new lease, assuming the new person meets your rental standards, with new signatures unless you want to hold the vacating tenant responsible for the remainder of their lease. In that event, simply add the new tenant to the lease and have them sign.
Question: Our tenants deposit their rent directly into our bank account. This has worked well… Read More

When tenants want to place clotheslines outside, landlords have plenty of discretion.
Under Assembly Bill 1448, they can require that clotheslines be kept in a private area and even dictate the look of the drying devices.
To help rental property owners properly handle resident requests, CAA has published a background paper and an addendum. Both forms, available only to CAA members, can be accessed here.
To learn more about AB 1448 by Assemblywoman Patty Lopez, D-San Fernando, watch the CAA video below. Click here to learn about other laws taking effect Jan. 1 and here for information on CAA’s new… Read More

If you’re a landlord who reaches for a can of Raid at the first sign of a cockroach or spider, prepare to break that habit.
A law taking effect in January targets pest control do-it-yourselfers in the rental housing business. Owners and their employees must begin notifying tenants whenever they personally apply pesticides, as opposed to using a pest control operator. Below, you’ll find detailed information for following the new regulations, as well as links to the forms you’ll need — available exclusively to CAA members.
In large part, the new notification rules for landlords reflect the kind of… Read More
Question: One of our tenants was recently arrested and is incarcerated. How does this affect his lease? Is it considered abandonment?
Answer: The incarceration of a tenant does not have a legal effect on the tenant’s right under the lease. If the tenant breaches any part of the lease agreement, such as non-payment of rent, the landlord may take legal steps to evict, and can serve notices to the tenant while in jail.
Question: One of our residents is a day sleeper and complains about the noisy children next door. They are under school age, and I don’t know how… Read More

During its annual breakfast meeting, the California Apartment Association’s Orange County division greeted the holiday season, took in a speech from a state senator and recognized several members who’ve gone above and beyond expectations.
In a presentation dubbed “Shaking up Sacramento,” state Sen. John Moorlach, R-Costa Mesa, pointed to problems with the state’s finances, including California having the nation’s highest unfunded pension obligations, starting with at least $140 billion.
Moorlach, who represents the state’s 37th Senate District, addressed about 200 attendees Friday, Dec. 5, at the Radisson Hotel Newport Beach. He is a familiar face in Orange County, where he… Read More

CAA North Coast educating council on ills of punitive policies
CAA North Coast eagerly awaits a consultant’s findings — expected to be completed next month — on possible ways to address Santa Rosa’s affordable housing crisis.
On Oct. 20, 2015, the Santa Rosa City Council voted 4-3 to hire the consultant, who is examining three possible approaches to the city’s housing issues: rent control, just‐cause eviction rules, and a process to provide mediation and arbitration between rental property owners and their residents.
The study derives from concerns of a housing crisis in the Santa Rosa region, where rental inventory is… Read More
