Thanks to the advocacy work of its members, the California Apartment Association now has more time to educate Los Angeles city officials about the problems of expanding their “just cause” eviction policies. On Thursday, the L.A. City Council’s housing committee was scheduled to consider applying the city’s “just cause” eviction rules to all housing in the city, including condos and single-family homes. Owners of rent controlled housing in unincorporated areas of Los Angeles County will be hit the hardest under newly approved rental registration fees. The annual fees include $90 for buildings covered by the county’s rent control ordinance and $30 on all other buildings. The county Board of Supervisors approved the charges Tuesday, despite opposition from the California Apartment Association. The fees apply in areas of the county that aren’t in any city jurisdictions.

The California Apartment Association has defeated a proposal to extend Los Angeles County’s emergency eviction moratorium until Aug. 31. The Board of Supervisors this week instead extended the moratorium until June 30. It can then be extended on a month-by-month basis. Despite immense opposition from CAA, the Los Angeles City Council on Wednesday voted to prolong its COVID-19 related rent freeze by more than a year, and likely much longer. Under the council’s decision, the rent freeze, which applies to locally rent controlled housing, will remain in place for one year following the expiration of the local COVID-19 emergency. The emergency, though, lacks a definite end date. The Los Angeles City Council on Wednesday rejected several items that posed threats to California’s rental housing industry, including a move that would have violated the Costa-Hawkins Rental Housing Act. On a 7-6 vote, the council: Rejected an extension of the city’s freeze on rent increases to property shielded from local rent control laws under Costa-Hawkins. The city attorney warned the council that such an action would violate state law. The Los Angeles County Board of Supervisors on Tuesday voted to give tenants a full year to cover rent that goes unpaid because of COVID-19. An earlier version of the moratorium had a six-month pay-back deferral period. The board also relaxed requirements that tenants show documentation of a COVID-19 related financial hardship, allowing renters to “self certify” their inability to pay rent. The board also expanded its policies to cover not only unincorporated areas of L.A. County, but also any cities that have not imposed their own COVID-19 eviction moratoria. The COVID-19 pandemic has prompted the city of Los Angeles to prohibit all rent increases in rent controlled units, approve a far-reaching eviction moratorium, and grant tenants one year to cover unpaid rent. These actions go well beyond a statewide eviction moratorium ordered last week by Gov. Gavin Newsom. Mayor Eric Garcetti’ ordered his prohibition on rent increases Monday night, affecting roughly 624,000 rent controlled units. In the city of Long Beach, planning a major renovation project is no longer enough to terminate a tenancy. Now, city landlords must also have a permit in-hand before proceeding with this type of eviction — a requirement that could delay remodeling projects. The city of Los Angeles also is pursuing this type of ordinance. Under AB 1482, the newly imposed statewide rent cap and “just cause” eviction law, landlords can file no-fault evictions for a few select reasons, including to perform substantial renovations to their properties.

A Los Angeles city councilman wants to lower the annual rent cap to 60% of the Consumer Price Index, the same formula used in San Francisco. At present, the annual cap on rent increases for rent controlled housing in L.A. comes to 4%, a figured determined by the rate of inflation. The city’s ordinance also includes a 3% floor, meaning rents can never be capped below 3% no matter what happens to CPI.
