A judge Wednesday denied CAA’s request to keep Mountain View’s rent control ordinance on hold pending the association’s legal challenge to the measure. The decision by Santa Clara County Superior Court Judge William Elfving means Mountain View’s rent control law, passed by voters in November as Measure V, takes effect immediately.

The California Apartment Association’s legal challenge to Mountain View’s rent control law is about to get its first court hearing. At 9 a.m. Tuesday, legal counsel for CAA will appear in Santa Clara County Superior Court to request a preliminary injunction against Measure V, the rent control initiative approved by Mountain View voters last November.

  The California Apartment Association and city of San Jose are asking local property owners to identify available units for residents displaced by recent flooding in Silicon Valley. “The California Apartment Association recognizes the urgent need for housing that the flood has placed on our already tight housing market,” said Anil Babbar, vice president at CAA. “It is because of this urgent need that we are placing a call to our membership to identify available rental units and provide that information to the city.”

Beginning next year, rental property owners in unincorporated areas of Santa Clara County will be required to accept Section 8 housing vouchers. The requirement comes under an ordinance passed by the county Board of Supervisors requiring that all people with the ability to pay for a given housing unit be considered for that unit, including those who would pay rent using Section 8 housing vouchers. The California Apartment Association argued that a mandated approach was the wrong one and that it is Section 8’s structural problems that dissuade many property owners from participating.

The city of San Jose has adopted a use-it-or-lose it approach to rent increases. On Tuesday, the City Council voted to eliminate the banking provision from its rent control ordinance. Under banking, owners of rent controlled properties can decide to forgo allowable rent increases one year, knowing that they can apply the unused increase sometime in the future.

Before a sold-out crowd Thursday, renowned economist Christopher Thornberg delved into the state of California’s rental housing market, including its present cooldown following several years of robust growth. Thornberg, founding partner of Beacon Economics, said growth has slowed as more housing supply has entered the pipeline. He offered his comments while kicking off the California Apartment Association’s Tri-County Outlook 2017 at Mountain View’s Computer History Museum. His talk also included an overview of the national election, its implications for the rental housing industry, and how proposed changes to the Affordable Care Act may affect renters.

After hearing from the California Apartment Association, the Menlo Park City Council has unanimously declined to study rent control and just-cause eviction policies. Instead, the council Tuesday agreed to study nearly 15 policies and programs to increase housing supply, help low-income families obtain affordable units, and develop a rental housing best-practices program for owners.

Rent rollbacks and other new requirements won’t take effect Dec. 23 A Santa Clara County Superior Court judge today agreed with CAA’s request to halt implementation of Mountain View’s new rent control law, also known as Measure V. Following a legal challenge from the California Apartment Association, the judge approved a temporary restraining order preventing the city from implementing the rent control law pending hearings and subsequent court rulings in early 2017.
