An Assembly committee has approved a bill that would make it discriminatory to deny applicants for rental housing simply because they have a Section 8 voucher. The bill, SB 329 by Sen. Holly Mitchell, D-Los Angeles, passed the Assembly Judiciary Committee on Tuesday on a 7-3 vote with two abstentions.

A bill intended to give renters the right to hang clotheslines outside their apartments is now far less onerous, thanks to amendments requested by the California Apartment Association. The revised AB 1448 by Assemblywoman Patty Lopez, D-San Fernando, advanced Tuesday from the Assembly Judiciary Committee by a 6 to 3 vote. It heads to the Committee on Housing and Community Development on May 13. Under revisions to the bill, the placement of clotheslines outside apartments is subject to landlord approval. The landlord, for example, could reject a tenant’s request to place a clothesline in an area that causes an eyesore.

A bill that would make employees liable for filing “bad faith” lawsuits passed the Assembly Labor and Employment Committee on Wednesday. AB 2095 by Assemblyman Donald Wagner, R-Irvine, targets frivolous litigation by awarding an employer attorneys’ fees when the defendant can prove the worker filed suit in bad faith. It would discourage litigation regarding technical violations on itemized wage statements that don’t harm the employee but end up costing employers thousands of dollars to defend in court. The California Apartment Association has helped derail a bill that would have given tenants new avenues to stall the eviction process. Assemblyman Tom Ammiano, D-San Francisco, tried to bring back the legislation as a two-year bill last week, but CAA’s arguments against AB 969 helped stamp out the measure shortly after lawmakers reconvened for 2014. The bill would have encouraged tenants who face eviction to claim retaliation by a landlord  and stop paying the rent.  It also promoted jury trials for eviction cases in courts where juries were not currently being used to decide cases.
