The California Apartment Association and a Los Angeles City Council committee Tuesday backed a proposal to scour the city for “soft story” apartment buildings vulnerable to collapse during a major temblor. The project would identify soft-story structures from roughly 29,000 apartment buildings erected prior to 1978. These types of buildings often have wooden frames and carports at ground level. Without proper reinforcement, they’re prone to significant damage during the intense shaking of an earthquake. Finding soft story buildings is likely a precursor to mandatory retrofitting. Following negotiations with CAA, Anaheim won’t make landlords pay to have code enforcement officers inspect the city’s apartments. Under an initial proposal, the inside-and-out inspections would have cost landlords $16 per unit and been a requirement to register rental housing with the city. After talking with the California Apartment Association, the city opted to allow landlords to do self-certifications. The CAA Compliance Committee has created three new rental forms and revised more than a dozen existing forms and related instruction sheets. Amendments to forms followed changes in the law, members’ requests or both. All are accessible through our rental forms page. Summaries of the three new forms:  Form 20.0 Notice of New Owner/Agent. This form is designed to provide notice of where to pay rent and who the agent is for service of process when the property is sold or changes management. Failure to provide this information promptly can limit the owner’s ability to evict for non-payment of rent.… Read More

Managers of apartments and condominiums should not have to post signs at their swimming pools prohibiting diarrhea-afflicted residents from the water. Such a ban is unenforceable, health protections are unproven, and the signs – which must have words or a diagram — are a magnet for theft. Unfortunately, the rule is already on the books for apartment and condominium pools built since September 2012. Nearly 650 CAA members gathered this weekend to honor the Greater Fresno area’s top rental housing professionals and properties. At the 16th Annual Mark of Distinction Awards Program on Saturday, Nov. 9, the California Apartment Association presented the Mark of Distinction Awards in 19 categories. Nominees submitted questionnaires judged by six panelists from various segments of the community outside the rental housing industry. In October, Gov. Jerry Brown signed AB 60, which provides for the issuance of drivers licenses to undocumented individuals and specifically prohibits discrimination against an individual because he or she holds or presents a license issued under the new law. Existing California law (Civil Code Section 1940.3) prohibits rental property owners and their agents from making inquiries about a tenant or applicant’s immigration and/or citizenship status.  These laws raise some questions about appropriate screening practices for undocumented applicants.
