The California Apartment Association today vowed to fight anti-housing activist Michael Weinstein’s efforts to have Gov. Gavin Newsom and the state Legislature suspend the Costa-Hawkins Rental Housing Act, California’s most important landlord-protection law.
CAA is preparing to mobilize its members to oppose any suspension of Costa-Hawkins, which would allow vacancy controls and authorize cities and counties to limit rent increases — even below the rate of inflation — on single-family homes, condominiums and apartments built after 1995.
Vacancy controls would keep local rent caps in place during changes in tenancy, preventing units from reaching market rates.
Although Weinstein claims his proposal… Read More

The California Apartment Association has challenged the city of Santa Ana and Contra Costa County for violating the Costa Hawkins Rental Housing Act.
Both jurisdictions, citing tenant hardships caused by COVID-19, imposed bans on rent increases, however, these prohibitions conflict with state law. The Santa Ana rent freeze applies to all tenants and all housing, regardless of housing type or age. The Contra Costa County ban failed to exempt newer units, which is a required under Costa-Hawkins.
These moves violate Costa-Hawkins, which prohibits local governments from imposing rent control on single-family homes and condominiums and on apartments built after 1995.… Read More

The Los Angeles City Council on Wednesday rejected several items that posed threats to California’s rental housing industry, including a move that would have violated the Costa-Hawkins Rental Housing Act.
On a 7-6 vote, the council:
Rejected an extension of the city’s freeze on rent increases to property shielded from local rent control laws under Costa-Hawkins. The city attorney warned the council that such an action would violate state law. The council also voted against extending the rent freeze to properties covered under Assembly Bill 1482, the statewide rent cap law that went into effect Jan. 1.

This Friday, Jan. 31, marks a key deadline: It’s the last day for a two-year bill (legislation introduced but shelved last year) to win passage in the house where it was introduced. So two-year Senate bills must pass off the Senate floor and advance to the Assembly, and two-year Assembly bills must advance to the Senate.
The highest-profile bill facing this week’s deadline is Senate Bill 50 by Sen. Scott Wiener, D-San Francisco.

The Inglewood City Council has decided to make its cap on rent increases even more draconian.
Despite opposition from the California Apartment Association, the council Tuesday voted unanimously to lower the city’s annual cap on rent increases to 3% — two percentage points lower than the 5% interim rent cap adopted earlier this year.
The rent control ordinance green-lighted this week, dubbed the Housing Protection Initiative, is scheduled to sunset in five years.
The City Council still must formalize approval of the ordinance with a second reading expected in 30 days.
During a televised round-table discussion of Proposition 10 last week, Debra Carlton of the California Apartment Association recalled the days before the Costa-Hawkins Rental Housing Act.
In 1995, the Legislature passed Costa-Hawkins to protect against extreme forms of rent control, including rent caps on single-family homes, individually owned condominiums and new construction. Before those protections were in place, many landlords were quitting the rental-housing business.
“Property owners were getting out,” Carlton, senior vice president of public affairs for CAA, said during an episode of KQED Newsroom. “Even in Berkeley, we lost about 3,000 single-family homes because owners said, ‘I’m not… Read More

The Santa Monica City Council on Tuesday declined to put forth a local ballot measure that would update the city’s rent rollback date if the Costa-Hawkins Rental Housing Act is repealed.
Should Proposition 10 pass and Costa-Hawkins be overturned, the city will instead rely on the Rent Board to adjust the city’s base rent, which remains set at 1978 levels but hasn’t been enforced since Costa-Hawkins became law.

The California Apartment Association, FPI Management and the California Association of REALTORS on Thursday warned state lawmakers, during an informational Assembly Housing and Senate Judiciary meeting, that an initiative to repeal the Costa-Hawkins Rental Housing Act would worsen the state’s housing crisis.
Debra Carlton, CAA’s senior vice president of public affairs, testified that repealing Costa-Hawkins would return an extreme form of rent control to California, bringing with it a slew of unwanted consequences.
If Costa-Hawkins is repealed, cities will be authorized to apply rent control to single-family homes and new multifamily housing. They’ll also be able to make rent caps… Read More

A statewide ballot measure that would repeal the Costa-Hawkins Rental Housing Act — and return extreme forms of rent control to California — has qualified for the Nov. 6 ballot.
On June 15, the Secretary of State’s office confirmed that rent control proponents had submitted enough signatures to place the repeal measure before voters. Official certification of the initiative is expected on June 28.
If Costa-Hawkins is repealed, cities will be authorized to apply rent control to single-family homes and new multifamily housing. They’ll also be able to make rent caps permanent, even after changes in tenancy. This type of… Read More
