A newly released survey highlights the impacts of the COVID-19 pandemic on California’s “mom and pop” landlords. Chief Justice Tani Cantil-Sakauye on Friday announced that California’s Judicial Council will vote “very soon” whether to sunset its emergency suspension of virtually all unlawful-detainer cases throughout the state. The announcement came during the Judicial Council’s regularly scheduled meeting Friday, July 24.

A tenant’s guest shoots and kills someone at the rental property. Another tenant threatens to behead the landlord. And a third renter runs a prostitution ring out of the unit. In each case, the landlord pursues an eviction, and each time, the judge says no. Gov. Gavin Newsom on Friday extended an executive order from March 16 that cleared the way for local governments to enact COVID-19 related eviction moratoria. The order had been set to expire Sunday but will now remain in effect through July 28. Most locally approved eviction moratoria were set to expire this weekend in line with Newsom’s March executive order. With that order now renewed, local eviction moratoria that were tied to the order also will remain in place. The California Apartment Association today urged the California Judicial Council to revisit its decision to suspend virtually all evictions in the state, saying the council’s move creates an unlevel playing field that will protect banks and tenants but leave rental property owners vulnerable well after the COVID-19 crisis ends.  The council’s decision, made Monday during an emergency meeting, allows tenants, including those with the ability to pay, to withhold rent without fear of eviction but leaves landlords struggling to pay their mortgages without protection from foreclosure.
