In response to the coronavirus pandemic, the Judicial Council of California on Monday placed on hold nearly all evictions in the state.
The council’s vote at an emergency meeting effectively suspended all unlawful detainer actions until 90 days after California’s COVID-19 state of emergency ends.
The vote goes much further than Gov. Gavin Newsom’s eviction moratorium, which he declared through an executive order last month. Effective
immediately and in time for rents due April 1, Gov. Gavin Newsom today banned
the eviction of renters unable to pay the rent because of COVID-19.
The
statewide executive order runs through May 31 and prohibits landlords from
evicting tenants for nonpayment of rent and prohibits enforcement of evictions
by law enforcement or courts.
“Although
CAA is still reviewing the details of the new executive order, the association continues
to appreciate Gov. Newsom for his continued leadership during the COVID-19

Tenant activists are organizing rent strikes in a number of California cities, with landlords in Los Angeles, Oakland and San Francisco as apparent targets.
The more radical tenant groups are spearheading the strikes, calling on tenants to withhold rent payments and demand that unpaid rent be forgiven in light of the COVID-19 crisis.
The demands come despite a statewide moratorium on evictions for non-payment of rent attributable to COVID-19. Just days after the city of Los Angeles imposed a COVID-19 related rent freeze and strict eviction moratorium, L.A. county appears poised to do the same.
The County Board of Supervisors is now reviewing steps taken by the city of L.A. for possible implementation throughout the nation’s most populous county, including within city limits.

In response to COVID-19-related financial hardships, the federal
government is offering a reprieve on foreclosures for qualifying owners of
single-family and multifamily properties.
The U.S. Department of Housing and Urban Development announced
that it will be halting all evictions and foreclosures until May 1 due to the
coronavirus pandemic.
This moratorium on evictions and foreclosures applies
specifically to single-family homes with mortgages insured by the Federal
Housing Administration, a HUD agency that backs affordable home loans issued

California Gov. Gavin Newsom has issued an executive order making it clear that local governments can impose eviction protections for tenants who are unable to pay their rent because of the coronavirus or loss of income as a result of the outbreak.
The California Apartment Association will work diligently to ensure that local governments that pursue such moratoria adopt reasonable measures for both rental property owners and renters and that their policies are consistent with the parameters in the executive order.

Despite massive turnout in opposition, the
Culver City Council voted this week to impose a 12-month cap on rent increases.
The ordinance,
approved on a 4-1 vote on Monday, took effect immediately. It limits rent
adjustments to 3% and brings both eviction controls and a rent registry to the
city.
The Vallejo City Council passed an urgency ordinance on July
16 making it unlawful to increase rent for an existing or prospective tenant by
more than 10% during a declared emergency.
The rent cap already was in place following a proclamation
of emergency declared by the city manager on June 27 and later ratified by the City
Council on July 3. The new ordinance simply places the rent cap into the
municipal codes so that it automatically becomes effective during any
proclaimed emergency.
