Thanks to the efforts of the California Apartment
Association, a proposal to implement a permanent “just cause” for eviction
ordinance, and impose it at the beginning of tenancies, failed to move forward
Tuesday.
The proposal would have gone further than AB 1482, the
upcoming state law that applies its just-cause provisions only after tenants
have been in place for a fixed amount of time.

The Los Angeles City Council on Tuesday approved an urgency ordinance intended to prevent no-cause evictions until AB 1482 takes effect, a move that several other California jurisdictions are also considering.
The Los Angeles ordinance is intended as a stopgap until the Jan. 1 implementation of AB 1482, the newly signed statewide rent control and “just cause” eviction law. Mayor Eric Garcetti signed the temporary legislation Tuesday afternoon.
The Milpitas City Council on Tuesday voted to impose an urgency ordinance that bans no-cause evictions until Jan. 1, when a state law with the same objective takes effect.
The council’s move is intended as a stopgap measure leading up to the implementation of Assembly Bill 1482, California’s newly signed statewide rent cap and “just cause” eviction law.

In a matter of days, Gov. Gavin Newsom is expected to sign Assembly Bill 1482, legislation that will cap rent increases statewide and become California’s most significant rental housing law in a quarter century.
During a special meeting Tuesday, the Milpitas City Council
decided to pursue an emergency “just cause” for eviction ordinance.
The council directed staff to draft the ordinance for council consideration when it meets Oct. 15. Because it’s an emergency ordinance, it would need 4 out of 5 votes to pass. If it does, it would take effect immediately and remain in place until the beginning of next year, when statewide “just cause” policies are expected to take effect under Assembly Bill 1482. The Chico City Council has postponed action on a “just cause”
eviction policy and instead referred the matter to an ad hoc council committee
headed by Mayor Randall Stone for further study.
No action on the matter is anticipated until after the city holds an all-day affordable housing conference scheduled for Sept. 28.

The city of Milpitas this week approved a non-binding rent-review program, as well as a requirement that landlords consider tenants who use Section 8 housing vouchers.
The council also scheduled a special meeting to consider an emergency “just cause” eviction proposal.
This year’s statewide rent-cap bill, including a series of amendments secured by CAA, has cleared both houses of the California Legislature and now awaits Gov. Gavin Newsom’s signature.
The Assembly, which needed to review amendments to the bill, approved the legislation last month on a 48-26 vote with five abstentions. The bill passed off the Senate floor on a 25-10 vote with five abstentions.

Over the objections of CAA, Los Angeles
County supervisors Tuesday voted unanimously to draft a permanent rent control
ordinance for the county’s unincorporated areas.
The ordinance is expected to limit annual rent increases based on the rate of inflation, which is now about 3%.
Supervisors instructed staff to return with the ordinance by Nov. 12.
