Thanks to the efforts of the California Apartment Association, a proposal to implement a permanent “just cause” for eviction ordinance, and impose it at the beginning of tenancies, failed to move forward Tuesday. The proposal would have gone further than AB 1482, the upcoming state law that applies its just-cause provisions only after tenants have been in place for a fixed amount of time. After hearing from CAA members, the council opted to adopt a temporary just-cause stopgap measure until AB 1482 takes effect Jan. 1. Unlike the permanent proposal, the stopgap measure will expire at the end of this… Read More

During a special meeting Tuesday, the Milpitas City Council decided to pursue an emergency “just cause” for eviction ordinance. The council directed staff to draft the ordinance for council consideration when it meets Oct. 15. Because it’s an emergency ordinance, it would need 4 out of 5 votes to pass. If it does, it would take effect immediately and remain in place until the beginning of next year, when statewide “just cause” policies are expected to take effect under Assembly Bill 1482. The council directed staff to draft the emergency ordinance to mirror exactly the just-cause section of AB 1482.

The Assembly, which needed to review amendments to the bill, approved the legislation last month on a 48-26 vote with five abstentions. The bill passed off the Senate floor on a 25-10 vote with five abstentions. AB 1482 by Assemblyman David Chiu, D-San Francisco, will cap annual rent increases at 5% plus the rate of inflation — which comes to about 8% at present — for much of the state’s multifamily housing… Read More
