The California Apartment Association has worked with the city of San Jose to require that tenants declare COVID-related financial hardships before qualifying for the city’s new rent freeze.
The new rent freeze ordinance, approved unanimously by the City Council Tuesday, took effect immediately and will run until June 30.
The rent freeze will apply only to tenants in rent-controlled units who give their landlords a declaration of COVID-19 related financial distress.

The San Jose City Council next week is expected to consider an ordinance that would freeze rents on all rent-controlled units for the rest of the year.
At this week’s meeting, the council directed the city attorney to return Tuesday, April 21, with an ordinance that:

A growing number of cities are issuing eviction protections for tenants financially strapped by the coronavirus.

The California Apartment Association has issued an “Industry Insight” paper to help rental housing owners comply with a Section 8-related ordinance that’s taken effect in San Jose.
Effective Thursday, Sept. 26, the city’s “Housing Payment Equality Ordinance” requires that landlords consider for tenancy all applicants with the ability to pay for a given unit, including those who would pay their rent using Section 8.
The enforcement provisions of the ordinance do not take effect for six months, but the director of the San Jose Department of Housing may issue written warnings for violations of the ordinance in the meantime.

California Apartment Association has launched a survey in its efforts to
improve San Jose’s
rental housing inspection program.
Specifically,
CAA Tri-County wants to hear from owners of rental property in San Jose that
have been placed in either the “Tier 3” or “Tier 2” code enforcement categories.
Under
San Jose’s Multiple Housing Program, apartment buildings are divided into tiers
based on the number of violations per unit of the buildings.
Each
tier has a different inspection cycle and fee structure, with the fewest
inspections and lowest fees for Tier 1 and the greatest for Tier 3.

Landlords losing the ability to use Ratio Utility Billing Systems on San Jose’s rent-controlled housing have just a few weeks left to apply for a one-time offset.
The petition period for the offset opened on July 5 and closes on Oct. 31. Any petition received after Oct. 31 will not be considered.

A bipartisan coalition of political leaders from across California has urged voters to reject a ballot measure that would repeal the Costa-Hawkins Rental Housing Act and return radical forms of rent control to the state.
The coalition, including officials from the city, county and state levels, says Proposition 10 would hurt local budgets while underming efforts to tackle California’s affordable housing crisis, the No on Prop 10 campaign said in a news release.

The San Jose City Council on Tuesday approved guidelines for property owners to phase out the use of ratio-utility billing systems, also known as RUBS, to charge tenants for utilities.
The council greenlighted the phase-out process one month after voting to ban the use of RUBS in the city’s rent controlled housing, defined as buildings constructed before 1979 with three units or more.
Some property owners use RUBS to divide utility bills among tenants based on the number of renters in the building or square footage.
