In the wake of the North Bay wildfires, the president and governor have issued a state of emergency in California, triggering protections under the state’s anti-price-gouging law. These protections prohibit raising the price of many consumer goods and services — including that of rental housing — by more than 10 percent after an emergency has been declared. The California Apartment Association provided testimony this week about the role of NIMBYism in the high cost of housing for the middle class. A proposal to bring a rent-review program to Lafayette received a mixed response from the City Council last week. The proposal, modeled after a program recently enacted in nearby Concord, was prompted by residents’ concerns over rent increases issued by new owners of a particular apartment complex in the city. During the Sept. 25 meeting, representatives from the California Apartment Association and local rental owners highlighted the fact that numerous housing providers in Lafayette not only have rents far below market, but also voluntarily limit rent increases to 10 percent annually.

The California Apartment Association reacted with skepticism this week to an online poll measuring voter support for rent control. The poll, which comes from the UC Berkeley Institute for Government Studies, found that a majority of California voters support the policy.

The Lafayette City Council next week will discuss a proposal to require mediation for rent increases exceeding 10 percent. The council will take up the potential rent-review ordinance when it meets at 7 p.m. Monday, Sept. 25, at the Lafayette Library & Learning Center – Community Hall, 3491 Mt. Diablo Blvd.

San Jose rental housing owners and managers now have until Sept. 22 to voice opposition to proposed changes to San Jose’s rent control law. The public comment period regarding the changes originally was set to expire Sept. 14 but has been extended to Sept. 22. “The city of San Jose needs to hear from you that the latest round of proposed changes to the city’s Apartment Rent Ordinance are excessive and not necessary,” said Anil Babbar, vice president of public affairs at CAA.

When voters rejected Measure C this past June, it put a protracted battle over rent control to rest in Santa Rosa.
