A proposal to apply “just cause” eviction policies to non-rent-controlled housing in Los Angeles got a boost this week from the City Council. At present, just-cause eviction requirements apply only to the city’s rent-controlled housing. But under a proposal gaining traction in L.A., just-cause would apply to the city’s entire housing stock, regardless of whether rents are regulated.

Some novel approaches to tackling California’s housing crisis are continuing to gain traction in the state Legislature this year. Take AB 73 by Assemblyman David Chiu, D-San Francisco. This bill, supported by the California Apartment Association, would incentivize local governments to zone for more housing.

Question: How can we enforce the entry rules clause in our lease? One of our residents is refusing to show the rental unit to a prospective purchaser of the building. Answer: California’s Civil Code specifically requires residential tenants to allow the landlord to show the rental unit to prospective purchasers and their agents. Failure to comply could lead to an action for unlawful detainer after service of a three-day notice to perform or quit if the resident refused to give reasonable dates and times for the entry.

The San Mateo City Council on Monday preliminarily approved a ban on smoking medical marijuana in multifamily communities. The city already banned smoking in apartments but until now made an exception for medical marijuana.

Despite objections from the California Apartment Association, Los Angeles moved closer Wednesday to expanding its eviction controls to the city’s entire housing stock. At present, Los Angeles’ just-cause eviction policies apply only to rental units that fall under the city’s rent control ordinance. On Wednesday, however, the council’s Housing Committee directed city staff to examine expanding just-cause eviction policies to all rental housing in the city, regardless of size, type or year built. Staff has 60 days to return with a report on a possible ordinance.

A bill that would crack down on rental property owners who discriminate against tenants based on immigration status passed out of the Senate Judiciary Committee this week. The committee’s 5-2 approval of AB 291 on Tuesday means the bill, by Assemblyman David Chiu, D-San Francisco, will likely head to the Senate floor within the next two weeks. The bill advanced to the Senate one month ago following approval by the full Assembly.

Amid strong opposition from the California Apartment Association, the Milpitas City Council on Tuesday backed away from a proposal to order immediate eviction controls for the city’s entire rental housing stock. The emergency just-cause eviction ordinance proposed for Milpitas would have applied to all rental housing in the city, regardless of size, type or year built.

Question: I am considering selling a duplex I own. Both sides are rented under one-year leases.  A potential buyer said he would need to move into one side of the unit and could not wait for the lease to expire. If there is a sale, doesn’t that terminate any lease I have with the tenants? Answer: A voluntary sale of leased property does not terminate the rental agreement or lease; the new owner steps into the shoes of the former owner and has the same rights and obligations of the former owner.

More than six months of rent control is coming to an end in the city of Sebastopol. The city, which has capped annual rent increases at 3 percent since Nov. 1, will allow its rent moratorium to expire by the end of today, June 16.
