The Anaheim City Council on Tuesday voted to help tenants cover unpaid rent accrued during the COVID-19 pandemic. The program will provide an additional $3 million in community relief funding to tenants unable to pay rent during the outbreak. Anaheim will provide a total of $5 million in housing assistance to its residents. The funding will kick in after the city’s eviction moratorium ends May 31, however the California Apartment Association is working with city staff to provide more immediate relief. CAA today condemned the threatened rent strikes that tenant advocacy groups are attempting to organize in California.  Extreme tenant-rights groups have urged all tenants to withhold May’s rent — even if unaffected by the COVID-19 pandemic.  Tom Bannon, chief executive officer for the California Apartment Association, said rent strike organizers are “irresponsible, unethical and unlawful.” Bannon also condemned tenants who see the pandemic as an excuse to cheat their landlord.   The strikes are intended to coerce rental property owners and elected officials into canceling rent and erasing any obligation to pay accumulated back rent. Such a policy is untenable and would create an exodus from the rental… Read More

On May 1, tenant activists are expected to make good on their threat to start rent strikes in California and elsewhere in the United States. The San Jose City Council on Tuesday night rejected a proposal to suspend rent collections during the COVID-19 crisis. The city attorney agreed with the California Apartment Association’s contention that the proposal violated the U. S. Constitution and was otherwise unlawful. Moreover, the city attorney conceded that a city-mandated rent suspension was a taking that subjected the city to costly lawsuits. As renters struggle to make timely payments to landlords during the COVID-19 crisis, rental property owners will find it difficult if not impossible to cover their property taxes on time.  That’s why the California Apartment Association has joined more than 50 other organizations in asking Gov. Newsom to partially suspend Revenue and Taxation Code sections 2618 and 4103. Such a move would give taxpayers, including owners of rental housing, until July 15 to pay the second installment of their property taxes, which is now due April 10. The coronavirus outbreak presents a health and financial crisis to all Californians. As the virus continues to spread, state and local governments are exploring eviction protections for tenants unable to pay rent because of the outbreak.
