The California Apartment Association has asked the state’s Judicial Council to further revise the jury instructions for eviction cases that go to trial following the passage of Senate Bill 91.
Passed in late January, SB 91 extended California’s eviction moratorium through June of this year. To avoid eviction, tenants now have until June 30 to pay at least 25% of rent debt that’s accrued since Sept. 1, 2020.
The Judicial Council’s proposed jury instructions revisions, however, leave out the new June 30 deadline for tenants to pay a quarter of what’s owed. The instructions also fail to explain what’s required… Read More

Gov. Gavin Newsom today signed a bill that will use $2.6 billion in federal funds to pay landlords up to 80% of rent owed by qualifying tenants with COVID-19 financial hardships.
The legislation, SB 91, won overwhelming bipartisan approval Thursday in both houses of the Legislature.
SB 91 will use federal funds to pay up to 80% of a tenant’s back rent accumulated between April 1 of last year and March 31, 2021. A landlord who accepts the money will have to forgive the remaining unpaid rent for that period. If the landlord refuses this arrangement, the maximum subsidy drops… Read More

President-elect Joe Biden said Thursday he would urge Congress to extend the nation’s COVID-19 eviction moratorium through September while also providing an additional $30 billion in rental assistance.
The rent relief would be part of a nearly $2 trillion stimulus plan that also includes $1,400 payments to qualifying individuals. The proposals would bolster the $25 billion in rental aid and $600 stimulus payments in the COVID-19 economic relief package approved in December.
The city of Los Angeles’ COVID-19 eviction moratorium violates the U.S. Constitution and puts landlords at risk of foreclosure and bankruptcy, according to a brief filed by the California Apartment Association.
The moratorium shields tenants from eviction for nonpayment of rent for two years, regardless of whether they can provide evidence of financial hardship tied to COVID-19.

A COVID-19 economic relief package signed by President Trump on Sunday includes $25 billion to help struggling tenants pay their landlords.
The aid package won Trump’s signature several days after passing both chambers of Congress. The president had threatened to veto the bill, saying its onetime direct payments to individuals should be increased from $600 to $2,000. Trump continues to urge Congress to make that change.
Last week, Tom Bannon, chief executive officer of the California Apartment Association, praised Congress for approving rental aid, the first time it’s done so since the pandemic shut down the economy nine months ago.… Read More

The California Apartment Association is calling on Congress to include COVID-19 rental assistance in its next federal relief package.
CAA on Dec. 11 urged its members to echo that request in emails to their representatives in the nation’s capital.
“As the debate over a new COVID-19 relief package proceeds, it’s critical that Congress provide short-term financial assistance for renters,” CAA’s message to Congress says. “This assistance would help them come current on the rent they’ve had to defer and help spare them an avalanche of rent debt in the coming months.”
Rep. Norma Torres

The Los Angeles County Board of Supervisors has postponed a decision on the future of its COVID-19 eviction moratorium.
Supervisors on Dec. 8 were prepared to renew and amend their ordinance, which expires Jan. 31, 2021. CAA, however, said it would be premature to act now, pointing to the possible extension or replacement of a statewide COVID-19 eviction moratorium.
Like L.A. County’s eviction ban, the statewide eviction protections are scheduled to sunset at the end of January. In Sacramento, however, lawmakers already are proposing bills to either replace AB 3088 or extend it, with timetables ranging from two months to… Read More
