The California Apartment Association has published an Industry Insights paper with answers to some of the most frequently asked questions on the COVID-19 Tenant Relief Act of 2020.
On Aug. 31, the state Legislature and governor approved AB 3088, immediately implementing the COVID-19 Tenant Relief Act, or CTRA. The urgency measure established sweeping protections against eviction for tenants financially impacted by the COVID-19 pandemic and has spurred numerous questions from rental property owners throughout California.

California landlords have until Wednesday, Sept. 30, to provide an informational notice to certain tenants who’ve missed rental payments during the COVID-19 pandemic.
The requirement comes from the COVID-19 Tenant Relief Act of 2020, which the state Legislature passed as Assembly Bill 3088 on Aug. 31.
The COVID-19 Tenant Relief Act, or CTRA, provides certain protections to residents who are unable to pay rent or other charges for one or more months between March 1, 2020 and Jan. 31, 2021 because they have experienced COVID-19-related financial distress, such as a loss of income or increased medical expenses. After the passage of AB 3088 this week, the California Apartment Association reached out to local elected officials throughout the state to make sure they’re aware of the law and how it works in their communities.
CAA’s local vice presidents sent emails to dozens of mayors, city council members and county supervisors after the Legislature approved, and the governor signed, AB 3088 — or the COVID-19 Tenant Relief Act of 2020.

Gov. Gavin Newsom today said the national eviction moratorium announced this week by the U.S. Centers for Disease Control will not apply in California because the Golden State already has stronger eviction protections in place.
The CDC is exempting locations with “the same or greater level of public-health protection than the requirements listed in this Order.”

Gov. Gavin Newsom late Monday signed the COVID-19 Tenant Relief Act of 2020, legislation that prohibits the eviction of renters with genuine COVID-related hardships but reopens the unlawful-detainer process for tenants who cause problems at the property.
The legislation, AB 3088, was signed into law shortly after passing the Assembly on a vote of 61-8 with 10 abstentions. Earlier Monday, the bill cleared the Senate on a 33-2 vote with five abstentions. The law took effect immediately.

The California Apartment Association has negotiated a less-burdensome alternative to Assemblyman David Chiu’s AB 1436.
The new bill is AB 3088, dubbed the COVID-19 Tenant Relief Act of 2020, and will be in print this afternoon.
Over the past week, CAA engaged in around-the-clock negotiations with the governor’s office and leaders in the Senate and Assembly on the new legislation.
The new proposal would allow landlords to evict tenants who cause problems at the property, such as by causing nuisances or threatening their neighbors. Negotiations are continuing on the bill, which is expected to be unveiled in the state Legislature by tomorrow morning.

A COVID-19 related bill that would invite tenants to skip rent payments without fear of eviction continues to work its way through the state Senate.
On Wednesday, AB 1436 by Assemblyman David Chiu, D-San Francisco, passed the Senate Judiciary Committee on a 6-0 vote with three abstentions.

The California Apartment Association this week asked its members for help stopping AB 1436, the “free rent” bill to be heard Tuesday in the Senate Judiciary Committee.
The bill by Assemblyman David Chiu, D-San Francisco, would make rental property owners defer rent payments for tenants who are either unable — or unwilling — to pay for housing during the COVID-19 pandemic.

California’s Judicial Council today voted 19-1 to allow the courts to resume processing unlawful-detainer cases effective Sept. 1.
The Judicial Council had been eyeing Aug. 14 to resume evictions, however, Chief Justice Tani Cantil-Sakauye urged her colleagues to wait two weeks.
