The Culver City Council on Sept. 21 is expected to review a draft of a draconian local rent control ordinance being considered for permanent adoption. If ultimately approved, the measure would become one of the worst rent control ordinances in California.  The California Apartment Association opposes the upcoming ordinance, which includes onerous policies such as: Pegging allowable rent increases to the Consumer Price Index. The continued spread of wildfires in California has led to new declarations of emergency from Gov. Gavin Newsom. Each of the emergency proclamations trigger protections against price gouging, including rent increases over 10%. Gov. Gavin Newsom The latest emergency declarations came Sunday. Counties named in the declaration include Fresno, Madera and Mariposa counties, due to the Creek Fire; San Bernardino County, due to the El Dorado Fire; and San Diego County, due to the Valley Fire. The California Apartment Association has negotiated a less-burdensome alternative to Assemblyman David Chiu’s AB 1436.    The new bill is AB 3088, dubbed the COVID-19 Tenant Relief Act of 2020, and will be in print this afternoon. Over the past week, CAA engaged in around-the-clock negotiations with the governor’s office and leaders in the Senate and Assembly on the new legislation.   The new proposal would allow landlords to evict tenants who cause problems at the property, such as by causing nuisances or threatening their neighbors. The city of Fresno will waive inspection fees for landlords when apartment checkups resume next month following a nearly six-month hiatus due to the COVID-19 pandemic.  The City Council voted 7-0 Thursday to restart residential interior inspections using virtual technology. Inspections have been suspended since March to prevent the spread of coronavirus to both renters and city staff.

Thanks to the advocacy efforts of CAA and its allies, Santa Barbara city officials this week modified a costly and unfair formula for calculating renter-relocation fees. The Santa Barbara City Council’s ordinance committee advanced a “just cause” for eviction and relocation assistance measure with modifications sought by the California Apartment Association.

A COVID-19 related bill that would invite tenants to skip rent payments without fear of eviction continues to work its way through the state Senate. On Wednesday, AB 1436 by Assemblyman David Chiu, D-San Francisco, passed the Senate Judiciary Committee on a 6-0 vote with three abstentions.

When a Santa Rosa tenant repeatedly violates the county’s COVID-19 health order, he or she could face a penalty for the transgression. But thanks to the California Apartment Association, the renter’s landlord will not. That protection for rental property owners was part of an urgency ordinance adopted by the Santa Rosa City Council Aug. 11. The ordinance enables the city to enforce Sonoma County’s rules for preventing the spread of coronavirus and sets up a system for warnings and fines.

A judge last week ruled that a local rent control initiative belongs on the Burbank city ballot, even though the city’s clerk disqualified the measure just two months ago. In June, Burbank City Clerk Zizette Mullins rejected the petition because it lacked some legally required wording. Price-control advocates, who had submitted the required number of signatures to qualify the measure, responded with a legal challenge. On Friday, L.A. Superior Court Judge Mary H. Strobel ruled in their favor.
